Choosing the Right Court Jurisdiction
This is important and your solicitor will assist here.
Litigants often think ‘High Court’ when issuing proceedings. However, courts have thresholds in compensation levels: in the District Court the ceiling is €15,000; the Circuit Court it is €75,000 and the High Court above €75,000.
The costs in these courts vary according to jurisdiction, the High Court being the highest. It is likely a case will be heard faster in the District Court and Circuit Courts than the High Court.
The court cost is important because if a case is taken in the High Court and the plaintiff loses, the costs he will have to pay will be much higher than if he lost in the Circuit Court. Moreover, if the plaintiff loses, he will usually face having to pay his own and the defendant's costs as well.
